Terms of Service

The rules of using Agency Pulse. Read these carefully — using the platform means you agree to them.

1. Who we are

Agency Pulse is a sales tracking platform for licensed insurance agents and the agencies that support them. The service is operated by James Maroney, based in San Diego, California. You can reach us at jackmaroney90@gmail.com.

2. Your account

You need an account to use Agency Pulse. You agree to provide accurate information when you sign up and to keep your login credentials secure. You're responsible for everything that happens under your account.

You must be at least 18 years old to use Agency Pulse.

3. What you can do with the service

We grant you a personal, non-exclusive, non-transferable, revocable license to use Agency Pulse for tracking your insurance sales activity. You may not:

4. Subscription and billing

Some features of Agency Pulse require a paid subscription. By starting a subscription you authorize us (through Stripe, our payment processor) to charge your payment method on a recurring basis at the price shown when you subscribed.

Free trials require a valid payment method up front. If you don't cancel before the trial ends, you'll be charged automatically.

You can cancel anytime from your billing portal. Cancellation stops future charges but does not refund the current billing period — you keep access through the end of the period you've already paid for. We do not issue refunds for partial periods or unused time.

If a payment fails, we'll attempt to re-charge your payment method. Continued payment failure may result in your account being downgraded or suspended until the balance is resolved.

5. Your data

You own the data you put into Agency Pulse — your sales records, your activity logs, your team rosters. We don't sell it, and we don't share it with third parties except as needed to operate the service (such as our hosting provider Supabase and our payment processor Stripe).

6. Service availability

We work hard to keep Agency Pulse running reliably, but we can't guarantee uninterrupted service. We may need to perform maintenance, fix bugs, or update features — sometimes with little notice. We're not liable for losses caused by downtime, data sync delays, or platform changes.

7. No professional advice

Agency Pulse is a tracking and analytics tool. It is not legal, financial, regulatory, or compliance advice. Insurance licensing, appointment, and sales rules vary by state and carrier. You're responsible for understanding and complying with the rules that apply to your work.

8. Termination

You can stop using Agency Pulse at any time by canceling your subscription and signing out. We can suspend or terminate your account if you violate these terms, abuse the platform, or engage in conduct that puts other users or the service at risk.

9. Limitation of liability

To the fullest extent permitted by law, Agency Pulse is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

10. Changes to these terms

We may update these terms from time to time. If we make a material change, we'll notify you by email or through the app. Continued use of Agency Pulse after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in San Diego County, California.
